By accessing or using cowtic ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including event organizers, ticket purchasers, and visitors to our platform. By creating an account, purchasing tickets, or using any feature of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

cowtic is an event ticketing platform that enables users to create, manage, and sell tickets for events, as well as purchase tickets for events created by other users. The Service includes features for event management, ticket sales, payment processing, and customer communication.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason we deem necessary to protect the integrity of the Service.

4. Event Organizers

4.1 Event Creation

Event organizers are responsible for the accuracy of all event information, including dates, times, locations, descriptions, and ticket pricing. Organizers must ensure they have the legal right to host the event and sell tickets.

4.2 Event Cancellation and Refunds

Event organizers are responsible for establishing and communicating their refund and cancellation policies. cowtic is not responsible for event cancellations, postponements, or changes. Refund requests must be handled directly between the organizer and ticket purchasers, subject to the organizer's refund policy.

4.3 Payment Processing

Payment processing fees may apply to ticket sales. Organizers are responsible for all applicable fees, which will be clearly disclosed before event creation. Payments to organizers are subject to our payment terms and may be subject to holds or delays for security purposes.

5. Ticket Purchasers

5.1 Ticket Purchase

By purchasing tickets through cowtic, you agree to pay the listed price plus any applicable fees. All sales are final unless otherwise stated in the event organizer's refund policy.

5.2 Ticket Validity

Tickets are valid only for the specific event, date, and time listed. Tickets are non-transferable unless explicitly allowed by the event organizer. Resale of tickets may be restricted or prohibited.

5.3 Event Attendance

Ticket purchasers are responsible for attending events at the correct date, time, and location. cowtic is not responsible for missed events due to user error or circumstances beyond our control.

6. Fees and Payments

6.1 Service Fees

cowtic may charge service fees for ticket sales and other transactions. These fees will be clearly disclosed before completion of the transaction. Fees are non-refundable except as required by law.

6.2 Payment Processing

Payments are processed through third-party payment processors. By using the Service, you agree to the terms and conditions of our payment processors. We are not responsible for payment processing errors or delays caused by third-party processors.

6.3 Refunds

Refund policies are determined by event organizers. cowtic does not guarantee refunds. Refund requests must be submitted to the event organizer in accordance with their stated policy.

7. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Create fraudulent events or sell counterfeit tickets
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Use automated systems to access the Service without permission
  • Impersonate any person or entity or falsely state your affiliation
  • Collect or store personal data about other users without permission
  • Use the Service to transmit spam, viruses, or malicious code
  • Violate any intellectual property rights of others
  • Engage in any activity that could harm the reputation or operation of cowtic

8. Intellectual Property

8.1 Our Content

All content on the Service, including text, graphics, logos, and software, is the property of cowtic or its licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2 User Content

You retain ownership of content you create or upload to the Service. By uploading content, you grant cowtic a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content as necessary to provide the Service.

9. Disclaimers and Limitation of Liability

9.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

9.2 Event Responsibility

cowtic is not responsible for the quality, safety, or legality of events listed on the platform. We do not endorse or guarantee any events or organizers. All interactions between organizers and ticket purchasers are at their own risk.

9.3 Limitation of Liability

To the maximum extent permitted by law, cowtic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Indemnification

You agree to indemnify, defend, and hold harmless cowtic, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

11.2 Dispute Resolution Process

Any disputes arising from or relating to these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with Swiss arbitration rules.
